Another delay in trial for man charged in death of girlfriend at The College at Brockport

Another delay in the trial of a man accused of beating his girlfriend to death in her College at Brockport dorm room. 

Clayton Whittemore’s trial will now start May 12. He’s charged with second-degree murder in the death of Alexandra Kogut. 

This is the fourth delay in the trial of Clayton Whittemore. He’s been in jail for about 17 months. He walked in court Tuesday wearing glasses and an orange jumpsuit. 

Whittemore's attorney says the defense expert needs more time to review the psychiatric evaluation by the prosecution. Judge Daniel Doyle granted that request, but told the attorneys that this is it; there will be no more delays of this trial. 

Last month, the court released video tapes of deputies questioning Whittemore and 911 calls he made. He’s accused of beating Alexandra Kogut to death with a curling iron in the fall of 2012. 

Monroe County District Attorney Sandra Doorley is prosecuting the case herself. She says the defense has asked for a manslaughter plea, but Doorley says this is a case of second-degree murder. 

Sandra Doorley, Monroe County District Attorney, said, “This is not a case of who done it, but why was it done. So I believe the expert opinions in this case offered by the defense and the prosecution will be key. So I don't believe we should be rushing those evaluations.”

News10NBC asked the defense how Whittemore is doing...

Mark Curley, Whittemore’s attorney, said, “He's doing as well as he can do. It's very stressful for everyone getting ready for trial. We want to get this done right. We want to do it properly. As much time as this will take, that's what it will take.”

Doorley says it appears Whittemore's attorneys are preparing for a defense of extreme emotional distress.

Again, the case has been delayed another month. If convicted. Whittemore faces 25 years to life.
