September 22, 2017 11:27 PM

Nearly two years after murder charges were dropped against a Pittsford man in the death of his father, federal gun charges have been filed against Charles Tan.

Earlier this year, an appellate court ruled Tan couldn't face a new trial for the death of his father, Jim. Charges were dismissed against Charles Tan following a mistrial in the case after a jury failed to reach a verdict in 2015.

In a new indictment, Tan is charged with receiving a firearm and ammunition with intent to commit an offense and false statement during purchase of a firearm.

Tan was charged with murder after his father was found shot in their Pittsford home in January of 2015.

Prosecutors said Tan, who was attending Cornell at the time, tried to buy a gun at the Cortland Walmart, but was denied. Afterwards, they say a friend of Tan's bought a shotgun that was used in the murder.

The U.S. Attorney of the Northern District tells us Tan was taken into custody crossing the Lewiston Bridge from Canada. News10NBC is told Tan will be arraigned Saturday afternoon at 4 p.m. in Syracuse.
