Man charged with DWAI in crash that killed child on Halloween 2014

A man is now facing charges for a deadly crash on Halloween 2014.

Rodney Lowe has been charged with two counts of driving while ability impaired.

Prosecutors say Lowe was driving the vehicle that hit three-year-old Tayvier Granderson on Latta Road while he was out with his family trick-or-treating. Granderson was killed in the crash. 16-year-old Nicole Moore was also seriously injured.

At the time of the crash, police said Lowe couldn't see the kids and said there were no obvious signs of impairment. But, court papers now claim Lowe had been drinking alcohol and had diazepam in his system.

Prosecutors say he faces a year in prison if convicted. He will be back in court on August 18. Prosecutors add the charges were issued following a long investigation and came after waiting on toxicology reports and performing accident reconstruction.
