Rochester City Court Judge Leticia Astacio will appear in court next week regarding two accusations that she violated her probation.
Judge Astacio is accused of violating her probation from a DWI conviction last year. This alleged violation is related to Astacio’s ankle monitoring device. She has been wearing it since she was released from jail in July.
Prosecutors say the device registered for alcohol the day after she walked out of jail. Astacio told probation officers that her foot cream was the reason for the positive reading.
Astacio, who had been accused of violating her conditional release multiple times after the initial DWI sentence, will have a new lawyer representing her this time around. In a separate probation violation accusation, Astacio is accused of leaving Monroe County.
On Aug. 31st Astacio stopped showing up for work. She is still being paid as she waits for the state's commission on judicial conduct to make a decision about her future on the bench.
Astacio will be in court on Monday, Oct. 23.
