She was sentenced to five years in prison for punching an elderly Walmart employee in the face and now she will be out on bail.
The Genesee County District Attorney tells News10NBC that a $50,000 bail bond was posted Wednesday with the Genesee County Court on behalf of Jacquetta Simmons.
Simmons was found guilty in August of punching 70-year-old Grace Suozzi, a Walmart cashier, in the face. Last month, a judge ordered her sentence to be put on hold until an appeals hearing. Her attorney is expected to argue her five year sentence is too harsh for someone with no prior criminal record.
News10NBC checked with the New York State Department of Corrections. They say that Simmons has not been released and is still at the Bedford Hills Correctional Facility because they have not received any paperwork on her bond or release order. Simmons is also pregnant and due this month.
