A former Gates Chili basketball coach, who had sex with a 16-year-old student at Tinseltown Movie Theater was in New York State Supreme Court Wednesday.
Judge Alex Renzi has to decide where Monte Nowden will be a Level 1 or Level 2 sex offender.
Nowden is due to be released in August and will have to register as a sex offender. The Department of Corrections assessment designated Nowden as a Level 1 sex offender, the lowest level. But the District Attorney's Office says he should be a Level 2.
What's the difference? Level 1 is for a determinant amount of time. Level 2 is for life.
Nowden said in court Wednesday that he takes responsibility for his actions and looks forward to being a productive member of society again.
Judge Renzi will issue a written decision on Nowden's sex offender status. News10NBC will let you know when that comes out.
