Teen charged with shooting RPD officer in court

Tyquan RiveraThe teen charged with shooting a Rochester Police officer was back in court this morning. It was pre-trial hearing dealing with the testimony of witnesses who put 15-year-old Tyquan Rivera at the scene the day of the shooting.

He is charged with second-degree attempted murder and assault in the January 31 shooting of Officer Anthony DiPonzio. DiPonzio has been recovering from severe wounds to his head.

In court this morning, several Rochester Police officers gave their account of the events. One of them saw DiPonzio on Dayton Street where the shooting happened the day of the shooting. Another witness testified that he saw Rivera leaving the area that day. An investigator told the court this morning he interviewed a 13-year -old who says he sold Rivera a gun in the summer of 2008.

The purpose of today's hearing was focused on these identifications and to make sure nothing improper occurred in the procedures used that would taint this evidence.

Monroe County District Attorney Mike Green said, “We were putting the testimony in to show particular witnesses knew the defendant. It wasn't as if they were identifying someone who was they had never seen before. This was someone who was known to them. Just confirming the identifications.”

The judge is scheduled to rule on today's hearing July first. Rivera's trial is scheduled for mid-August where DiPonzio is expected to testify.
