News10NBC has learned that there has been a stay in the sentencing of a Batavia woman convicted of punching a 70-year-old Walmart employee.
Jacquetta Simmons was found guilty of assault in August. Earlier this month, she was sentenced to five years in prison for punching Grace Suozzi in the face last Christmas Eve, but News10NBC has learned that the sentenced has been stayed pending an appeal. During sentencing, News10NBC learned that Simmons is pregnant and is due next month.
Simmons will remain in jail until she posts her bail on $50,000. Her defense attorney has until May 31 to present their case.
