Judge sets Bruno trial for December

A federal judge has scheduled a second trial Dec. 2 for a new fraud trial for the former leader of New York's Senate although defense attorneys are pursuing a further appeal.
 
U.S. District Judge Gary Sharpe has ordered prosecutors and defense attorneys to file trial briefs and witness lists in advance.
 
The 84-year-old Bruno's two fraud convictions from 2009 were overturned on appeal.
 
Prosecutors say he accepted more than $400,000 from a businessman for helping with state grants.
 
He denies any wrongdoing and was acquitted of five charges.
 
Sharpe says the Second Circuit Court of Appeals unanimously upheld his earlier ruling, refusing to dismiss the charges on double jeopardy grounds.
 
Defense attorneys have asked the Second Circuit to reconsider their appeal.
