A Batavia woman, sentenced to five years in prison for punching an elderly Walmart employee in the face, will only have to serve one year behind bars.
According to The Batavian, an appeals court also ruled that Jaquetta Simmons will serve the rest of her sentence in county jail and not state prison.
Simmons' sentence was placed on hold because her attorney argued five years is too harsh for someone with no prior criminal record. Simmons was also pregnant at the time.
She was found guilty in August 2011 of the attack which was caught on security video.
