A Rochester man has been pleaded not guilty to murder charges after police say he shot and killed a man who was sitting inside his car last month.

Jose Rosario pleaded not guilty to second-degree murder. Police say Rosario shot and killed 33-year-old Jorge King-Hernandez while he was stopped at a red light at Upper Falls Boulevard and Hudson Avenue on February 6.

His attorney says he wasn't the shooter and had nothing to do with the crime. The assistant district attorney says Rosario is charged under an accomplice theory and he believes other people were involved.

Rosario is currently in the Monroe County Jail.
