I-Team 10 Follow-Up: More Medley Centre activity

Cleaning crews were on site at the empty Medley Centre as the owners of the mall deal with accusations of code violations.

The town wants the owner to prove he’s made necessary repairs to the fire sprinkler system that ruptured. On Monday, I-Team learned the fire marshal has filed a report claiming additional code violations.       

The town of Irondequoit is already taking mall owner Scott Congel and his company, Bersin Properties, to court for code violations at the Medley Centre. Now, I-Team learned the fire marshal was at the mall on Friday with police and reported seeing additional problems.

From the parking lot, you can still see the carousel as well as tables and chairs, which remain inside the closed mall. The town has apparently decided those items need to be removed. Because there’s no working fire sprinkler system inside, the town considers them combustibles and a further violation of building codes.

I-Team 10 has learned that on Friday, Irondequoit Police filed a report at the request of the fire marshal. It’s the latest move by a new town administration that seems unwilling to cut the mall owner any more slack in hopes that a promised billion dollar re-development will materialize. 

Owner Scott Congel is already facing a future court date for failing to prove that he's addressed code violations.

I-Team 10 obtained pictures from inside the Medley Centre taken by the fire marshal after a sprinkler pipe burst in January causing major water damage. As a result, the mall was cited for failing to have a working fire suppression system and for having combustibles inside, specifically Christmas decorations in a storage room.

In a letter to the town, Congel claims he's addressed the violations and accused the town supervisor of grandstanding. But based on what I-Team 10 witnessed Monday, there's additional clean-up still being done. Crews were on hand at the normally locked-up portion of the mall. I-Team 10 watched as they unloaded a power washer, vacuum and other cleaning items and took them inside. 

As for the code enforcement actions, I-Team 10 checked and found that a judge has signed off on the summons and the town will now have to serve Congel before a court date is set.
