Four-time convicted felon accused of firing a shot at someone in Webster

WEBSTER, N.Y. (WHEC) — Webster police said a four-time convicted felon fired a shot after a confrontation over trash being thrown from his car.

Police said two cars were stopped at a traffic light on Saturday evening when trash was thrown out the window of one of the vehicles. A man and woman from the second car exited, picked up the trash and tried to give it back to the first car. That’s when a man allegedly got out of his car and pointed his gun at them. They called police.

Police say he ran back to his car as it started to roll away, only to return and fire a shot in the caller’s direction. The man and woman who were targetted ran back to their vehicle and were not injured. The suspect and driver took off but the vehicle was later recovered in Rochester.

Damien Spears was charged with criminal possession of a weapon after police identified him as the man who fired a gun on Lake Road near Sandbar Park. He is prohibited from possessing a gun because of his criminal record.

Webster police and the New York State Division of Parole arrested Spears for the crime on Thursday. He is being held at Monroe County Jail without bail and was arraigned in Webster Town Court.
