ROCHESTER, N.Y. (WHEC) — A Rochester man accused of killing another man near a school playground earlier this month was indicted Thursday.

Police say 21-year-old Derrick Gunter killed Waltequaries Evans near School #17 on Orchard Street back on Dec. 13.

Gunter lives in Florida but is from Rochester. He was indicted on second degree murder and two counts of second degree criminal possession of a weapon.

Initially, police said the shooting happened over an argument.

Evans was just 15 years old when he escaped a deadly arson at a home on Grape Street in 2012. He was seriously burned and four other children were killed.
