Sandra Doorley calls Tan trial outcome appalling

Monroe County District Attorney Sandra Doorley is not happy that the Charlie Tan murder charge was dismissed on Thursday.

Doorley went so far as to call this decision unprecedented. She says the perception for a lot of people is that what happened on Thursday to Charles Tan would never have happened to a person arrested in the city.

"This is appalling," said Doorley. "In my 24 years, I've never in my life experienced anything like that."

Doorley adds, "This whole trial presented a unique set of facts, but the decision this morning is definitely unprecedented."

Doorley says she disagrees with Judge Piampiano's ruling that the evidence was legally insufficient. She says her office is considering all legal options moving forward, but says thanks to the rule of double jeopardy. Tan cannot be charged again for the same crime.

Doorley says, "He can't be again tried on murder, but it would have to be something outside of the scope of the circumstances."

We also asked if the DA's office is considering charging other people in connection to the death of Tan's father, Jim. She says nothing is off the table. "Right now it does not appear there is a direct right of appeal under the statute for this type of situation because of the circumstances."

She continues, "But there are other legal remedies that we are looking into and hopefully we're going to have commenced a legal action by the end of the day."

Doorley says she stands behind prosecutor William Gargan. She says he presented a solid case and says if they had been able to re-try the case in front of another jury, she believes there would have been a very different outcome.

Doorley's office sent us a statement Thursday afternoon saying as soon they determine what legal action they can take, they will let us know. We can also tell you that Doorley has requested the interviews that News10NBC did with Judge Piampiano after Tan's trial a few weeks ago.
