The Rochester Police Department has arrested and charged the 41-year-old man they say left the area with a 14-year-old girl prompting an Amber Alert on Monday.
Robert Gonzalez is charged with criminal sex act, use of a child in a sex act, both felonies, and sexual abuse.
Gonzalez appeared in Rochester City Court Thursday morning to answer a bench warrant on a third-degree assault charge.
However, Rochester City Court Judge Charles Crimi dismissed the charge and released Gonzalez. News10NBC was there as Rochester Police investigators waited for Gonzalez outside of court and immediately took him into custody.
Gonzalez is expected to be arraigned Friday morning. He's accused of taking the young girl to New York City without permission from her mother.
The 14-year-old is still in New York City. She was in the hospital for evaluation.
Her mother told News10NBC's Lynette Adams that she has been in touch with her daughter and wants her returned home safely. She also says she is happy to hear that Gonzalez is in police custody.
