Appeal filed to keep Abigail Hernandez in US

An appeal has been filed on behalf of Abigail Hernandez. 

On Nov. 2, a judge denied Hernandez's request to remain in the U.S., but her lawyer reserved the right to appeal the judge's ruling and had 30 days to do so.

Since Nov.2, Hernandez had remained at the Buffalo Federal Detention Center in Batavia. 

Back in August, the former Rochester student was sentenced to three years probation after admitting to making a terroristic threat against East High School. 

Hernandez was in the country protected under the DACA program, but her status was revoked after committing the crime.
