Appellate court grants motion to move Astacio's trial out of Monroe County

An appellate court has granted a motion to move former Rochester City Court Judge Leticia Astacio's trial out of Monroe County.

Astacio, who was removed from the bench last year, is facing a felony gun charge after she tried to illegally buy a gun from two Dick's Sporting Goods stores in April. She's prohibited from owning a gun because she's on probation for her 2016 DWI conviction.

"Under the particular circumstances presented, we conclude that there is reasonable cause to believe that a fair and impartial jury cannot now be drawn in Monroe County," the appeals court wrote in its decision.

The trial will now be held in Onondaga County.

Mark Foti, the attorney representing Astacio, had previously expressed his concern over jury selection in Monroe County, telling News10NBC that 23 out of 23 people on the grand jury recognized Astacio and were familiar with the case.
