Astacio to remain in jail after judge refuses to hear bail application

A judge refused to hear a bail application for Judge Leticia Astacio on Wednesday, meaning the Astacio will remain behind bars for the time being.

Judge Astacio's attorney requested that Judge Kocher overrule Judge Aronson’s decision to hold her in jail on no bail until her hearing on Nov. 3. Judge Kocher denied her application, so Astacio will remain in jail on no bail.

Astacio has been in jail since her court appearance Monday, when a judge ordered her to be held without bail, at least until there is a hearing to determine whether or not she violated her probation. That is scheduled to happen November 3. Wednesday's hearing was to determine whether she should be granted bail in the meantime.

This follows accusations Astacio violated her probation, stemming from her 2016 DWI conviction. Probation officers say her ankle monitoring device detected alcohol. They're also accusing her of going to del Lago Resort and Casino twice without permission. 

Astacio's attorney says she has obeyed all of the rules of her probation. He added he doesn't think Astacio should even be on probation in the first place.
