Cuomo lawyer calls on AG’s office to investigate Albany sheriff, accuses sheriff of leaking information

ROCHESTER, N.Y. (WHEC) —Former New York Gov. Andrew Cuomo’s lawyer, Rita Glavin, claims the Albany County Sheriff’s Department illegally leaked information to the press about Cuomo’s sexual harassment case.

Glavin believes Sheriff Craig Apple is to blame for leaking information. She says Apple gave confidential grand jury information to the New York Post in August.

The Post article in question is from Aug. 30, and it references subpoenas related to the case. Cuomo’s lawyer says the only possible subpoenas at the time would’ve been from the grand jury, and in New York State it’s illegal to disclose information about grand jury proceedings.

Now, Glavin says she wants the Attorney General’s office to investigate, however she doesn’t want AG Tish James to take on the investigation herself. Glavin wants an outside agency or “independent prosecutor” to handle the investigation, saying James has a personal relationship with Apple, and citing James’ recent bid for governor.

Glavin previously called on Apple to hold on to any records of any communications his office had with the alleged victim, journalists or other investigators.

James has not responded to Glavin’s request for an investigation. As for the criminal case, Cuomo is charged with the misdemeanor crime of “forcible touching,” which an ex-aide to the governor says happened at the Governor’s Mansion last year.

Cuomo was supposed to appear in court on Nov.17 for an arraignment, but that’s been pushed back to Jan. 7.
