Grandparents of baby who swallowed bag of fentanyl found guilty in bench trial

ROCHESTER, N.Y. (WHEC) - The grandparents of a baby who swallowed a bag of fentanyl were found guilty Wednesday in a bench trial.

A judge found Bartolomeo Blackburn and Edaliza Torres guilty of endangering the welfare of a child and criminal possession of a controlled substance in the seventh degree. They were found not guilty on assault charges.

According to court paperwork, the nine-month-old baby old was unresponsive when emergency crews arrived at a home on Roycroft Drive in Rochester on June 3.

The baby was taken to the hospital and given Narcan for an overdose and survived.

The attorney for Torres says she is asking that her client does not get any jail time.

"I would be asking for time served sentence," Julie Cianca, Torres attorney said. "She did serve time in jail for this, not a particularly long time but the remorse and just listening to the 911 tape of what happened that day and just the pure panic, horror and voices and all the people involved on the body-worn camera that we saw... she's been through something I wouldn't wish on anybody.

Blackburn and Torres are facing a maximum of a year in jail. Both are scheduled to appear in court on May 8.
