A family member of the two people who were killed by carbon monoxide poisoning in Orleans County is speaking out about the suspect arrested in the case.
David Wiley Jr., 39, was arrested last week and he's facing charges of criminally negligent homicide in the deaths of 39-year-old Joan Gilman and her 14-year-old son Richard.
Prosecutors say he was reckless by running a gas powered generator in the garage of the Kendall duplex where the Gilmans lived.
Joan Gilman's brother-in-law, who is also a longtime friend of Wiley's, said Wiley should have known better.
"Guy works construction his whole life," Larry Divito said. "He worked with generators to get himself power on construction sites. I mean, everybody knows anything with a gas engine, you don't want it indoors. There are big yellow stickers on the top of them that say so."
If convicted, Wiley could serve up to seven years in prison. He is out of jail on $2,500 bail.
