ROCHESTER, N.Y. (WHEC) — Former Rochester City Court Judge Leticia Astacio violated the conditions of her probation, according to court paperwork obtained by News10NBC.
Astacio allegedly failed to report to her probation officer on Aug. 13 and Aug. 20.
She is also is accused of failing to cooperate with the ignition interlock program on June 11. According to court paperwork, a report from the interlock program stated that a .043% BAC was recorded on startup. The retest registered a .00% BAC, and the camera was obstructed in both samples.
Astacio allegedly tested positive for alcohol on June 11 at the probation office. According to the court papers, Astacio "denied drinking but did admit to consuming (redacted) which does contain a small amount of alcohol." The court papers blacked out exactly what Astacio consumed.
The Monroe County District Attorney's Office confirmed she was arraigned Monday for violating the conditions of her probation.
Astacio was convicted of driving while intoxicated in 2016, while she was still a judge. She was removed from the bench in 2018 after losing her appeal on the ruling by the State Commission on Judicial Conduct.
