Immigration hearing taking place for Abigail Hernandez

A hearing is taking place Thursday to determine if the Rochester student who threatened to shoot up East High will be allowed to stay in the country.

We are expecting the immigration judge to make a final decision in the Abigail Hernandez case sometime Thursday.

Back in August, Hernandez was sentenced to three years probation for making a terroristic threat. After her sentencing, she was taken back into federal custody. 

She was in the country protected under the DACA program, but her status was revoked after committing a crime.

At a hearing in August, her attorney told the judge she intended to apply for asylum in the U.S.
