Judge Astacio says her sister, not her, tried to buy a gun

In a live Saturday night broadcast on a public Facebook page, Rochester City Court Judge Leticia Astacio says her younger sister attempted to buy a gun at Dick’s Sporting Goods store in Henrietta.

Astacio says the staff at Dick’s mistook her sister for her and refused to sell her the gun.


“They thought she was me,” Astacio said in the broadcast.

Dick’s contacted the Monroe County Sheriff’s Office which filed a report with Monroe County Probation.

Astacio is on probation in connection to her DWI conviction in August 2016.

Judge Astacio said in the Facebook broadcast that she is afraid of guns and says she has lost family members to gun violence but she said “it would make sense for me to purchase a gun because these psychopaths threaten me regularly.”

“I get death threats daily,” Astacio said.

She then said in the broadcast that she’s been afraid in her own home.

“If that doesn’t mean something to you I don’t understand anything about you,” she said.

Judge Astacio has reported to work at the Hall of Justice once since August 30. In several public broadcasts on Facebook she said her work arrangements are bad for her health and beneath that of an elected judge.

Judge Astacio was elected in 2012. Her term expires in 2024.

She has been barred from hearing cases since she violated the terms of her DWI conviction.

The New York State Commission on Judicial Conduct, the only entity in the state that can punish and remove an elected judge, is investigating Judge Astacio.
