CANANDAIGUA, N. Y. (WHEC) -- The initially deadlocked jury in the trial of a man accused of rape has found him not guilty.
Prosecutors say Michael Orbino dragged a woman behind a Byrne Dairy in Canandaigua and raped her back in 2008.
Earlier on Friday, jurors told the judge they were deadlocked but he told them to keep trying.
According to our news partners at Messenger Post, a lack of physical evidence complicated the jury's decision.
The issue was that the rape kit was destroyed.
Orbino is still in jail facing a stalking charge.
