Gates police: Suspect in road rage stabbing arrested in similar incident in same location

GATES, N.Y. (WHEC) — One man is seriously injured and another has been charged with attempted murder after a road rage incident in Gates Wednesday night. 

Police say this isn't the first the suspect has gotten in an altercation behind the wheel. In fact, he was arrested in a similar case in the same location just three months ago.


Wednesday's incident happened in the parking lot of the Wegmans on Lyell Avenue around 6 p.m.

Levar Merritt, 42, of Chili stabbed the victim, a 39-year-old Gates man, in the neck and leg, according to the Gates Police Department.

Investigators say it began as a road rage incident while the two men were driving on Lyell Avenue. They pulled into the Wegmans parking lot and started fighting.

Merritt walked up to an officer at the scene and surrendered. He was arrested in another road rage incident in the same location back in June. According to police, he threatened two people with a knife. He was charged with menacing and is awaiting trial in that case.

As for the incident Wednesday night, Merritt is charged with attempted murder, possession of a weapon, and assault. He is being held in the Monroe County Jail and is set to appear in court Tuesday, Oct. 29.

Right now, the victim is in "guarded condition" at Strong Memorial Hospital.
