After a train struck a tow truck in Pittsford last week, the village mayor said there had been an ongoing issue.
"There's been ongoing use of CSX property by the tracks by the owner of the gas station to move vehicles, to store vehicles, and for years we've been concerned about the encroachment on CSX property and the safety issues involved," Mayor Robert Corby told News10NBC after the crash.
Wednesday, deputies say the tow truck driver has been charged. 51-year-old Donald J. Schaeffer, employed by Action Towing, has been charged with a railroad law violation for encroaching on the railroad tracks, deputies tell us.
Investigators say the train struck the tow truck, which was partially on the tracks, around 4:15 p.m. on Friday.
Thankfully, no one was hurt, but deputies had to shut down Monroe Avenue during rush hour while they investigated and cleared the scene.
