Prosecutors in the fraud case against two top executives at a local development company have missed a deadline to turn over key evidence to defense attorneys.
Federal prosecutors say Todd Morgan, Bob Morgan's son, and Kevin Morgan, Bob Morgan's nephew, lied to banks to get funding.
According to the Buffalo News, prosecutors say they seized millions of emails and documents from the Morgan Communities office in Pittsford office back in May and need more time to go through them.
A judge extended the deadline to hand over the documents to Oct. 12.
Bob Morgan, the company's owner, has not been accused of any wrongdoing in the case.
