BUFFALO, N.Y. (WGRZ/WHEC) — The Buffalo protester pushed by Buffalo police officers in Niagara Square last summer has filed a federal court lawsuit against the city and police officers involved.

It's been nearly two weeks since the Erie County District Attorney announced a grand jury had dismissed the case.

A video showing 75-year-old Martin Gugino getting shoved by a police officer during a protest in downtown Buffalo went viral in June.

Gugino fractured his skull.

Gugino's lawyer tells our Buffalo affiliate that they want compensation for the severe injuries he suffered.

The suit names the City of Buffalo, Mayor Byron Brown, Police Commissioner Byron Lockwood, Deputy Commissioner Joseph Gramaglia and Officer John Losi as defendants.

A spokesman for the city told WGRZ that their corporation counsel will handle the case.
