Whole Foods developers drop lawsuit against former Assemblyman Errgio, Joseph Rittler

BRIGHTON, N.Y. (WHEC) -- The developers of the Whole Foods plaza in Brighton dropped a lawsuit against a former assemblyman and the man they think encouraged him to take a bribe that impacted their business.

Daniele Management & Development filed the suit in December.

Federal prosecutors say Assemblyman Joe Errigo accepted more than $10,000 in exchange for introducing legislation that would have given the state the power to veto local zoning changes.  

The lawsuit alleges the man who paid that bribe is former Monroe County political staffer, Joseph Rittler. 

The Daniele family sent News10NBC a statement Thursday saying, "We asked the judge to dismiss without prejudice, which allows us to reopen again if we chose to." 

Rittler also responded saying, "It is my opinion that this lawsuit was meant to tarnish my reputation... I am pleased that the Daniele's have come to their senses."
