GENEVA, N.Y. (WHEC) — A request to drop the case against a local police officer has been denied.
The officer is accused of choking a woman he was arresting. Geneva Police Officer Jack Montesanto is charged with obstruction of breathing, a misdemeanor.
The judge denied his request Friday, to drop the charge, according to the Finger Lakes Times.
Investigators say he used unnecessary force last July when arresting the woman for loud music and disorderly conduct.
The incident was caught on his body camera.
Montesanto is on unpaid suspension.
