CANANDAIGUA, N.Y. (WHEC) — The driver in the crash that killed Rochester Police Lt. Aaron Colletti earlier this month is facing charges.
Driver James M. Miller was charged with failure to use due care to avoid hitting a cyclist.
Miller struck and killed Colletti on June 11 while Colletti was riding his bike with his son.
The Ontario County Sheriff’s Office says an investigation revealed that Miller was not drunk or high at the time of the incident, and neither Miller nor Colletti were using their cell phones.
The OCSO says there was evidence to indicate Miller attempted to avoid hitting Colletti, but did not provide adequate room while passing him.
Miller was issued a citation and he is due back in Canandaigua Town Court at a later date.
