Employers rethinking drug screening policies with legalized recreational marijuana

ROCHESTER, N.Y. (WGRZ/WHEC) — With the state's new recreational marijuana law, many employers are rethinking their drug screening policies.

Our Buffalo affiliate spoke with Aleece Burgio, an attorney who sits on the New York State Bar Association's Cannabis Committee.

She says many businesses are still playing catch up when it comes to their policies surrounding pot because the new law also amended the labor law, adding marijuana as a substance you can consume during off-work hours.

"If you're drinking on a Thursday you can still go to work on a Friday, if you're smoking weed on a Thursday, you can go to work Friday the difference is when you're testing for marijuana it stays in your system for so long, it doesn't mean you're impaired," Burgio said.

Despite marijuana being legal, some companies, like General Motors, don't allow employees to smoke.

Union leaders believe that could soon change.

Other companies, like those who have federal contracts, still test for marijuana because it's not legal at the federal level.
