Family files notice of claim after Northwood Elementary School principal charged with sex abuse

HILTON, N.Y. (WHEC) — The family of one of the alleged victims of Northwood Elementary School Principal Kirk Asthon has filed a notice of claim.

Ashton is facing more than 25 counts of various sex abuse charges including seven counts of a second-degree pattern of sexual conduct with children, and seven counts of first-degree sexual abuse, both felonies. He's also charged with 11 counts of misdemeanor endangering children.

He's accused of sexually abusing 11 boys between the ages of 8 and 12, between 2017 and this year's spring break during his tenure as principal.

The notice of claim, which names Ashton, the Hilton Central School District and Superintendent Casey Kosiorek as the parties, was filed on behalf of the family of an 11-year-old Northwood Elementary School student. 

It claims the student was subjected to unwanted sexual contact by Ashton over four years. It alleges the student was instructed several times to eat his lunch in Ashton's office, sit on his lap and claims Ashton would rub and caress the child inappropriately.

According to the notice of claim, the Hilton Central School District failed in its duty of training, supervising, and hiring employees, and as a result of the abuse, the child's grades have suffered and the student has suffered emotional trauma.

The family is seeking damages. Jeff Wicks, who represents the family, says he has no comment.

News10NBC sent an email to the Hilton Central School District, who told us it still has not received the notice of claim. The district said it could not provide any further comment due to the pending litigation.
