Good Question: Which fireworks are legal?

ROCHESTER, N.Y. (WHEC) — Emails about this latest “Good Question” keeps filling our inbox.

One viewer asked: "Are fireworks legal in Monroe County and if so, what type?"


Another viewer added: "I thought selling fireworks was illegal in the city, let alone the state. This would be interesting to know what the current status is since ‘laws’ change.”

Those are just two of the many frustrated neighbors reaching out to News10NBC for answers as fireworks continue to go off in the middle of the night.

To be very clear, whoever is doing this is breaking the law.

There’s no middle ground in the rules. You can buy and sell "sparkling devices" which are those sparklers you hold in your hand or light up fountain cones that sit on the ground.

A few counties, mostly near NYC and Albany, even ban those.

All other fireworks that shoot in the air like roman candles or bottle rockets are banned statewide. You can still get them in other states like just across the border in Pennsylvania.

You're bound to see pop-up tents in town. They are allowed to sell legal products through July 5.

If you see a place selling illegal fireworks or if you hear them again tonight, police want you to call 911. Anyone caught shooting them can face misdemeanor charges or a felony if you cause a fire.
