Judge denies motion to dismiss charges against Mayor Warren's husband, Tim Granison

ROCHESTER, N.Y. (WHEC) — The case against the husband of Rochester Mayor Lovely Warren will move forward.

Timothy Granison appeared in court Wednesday to ask the judge to dismiss the charges against him because he was denied an opportunity to testify at the grand jury hearing.

However, the judge dismissed the motion, leaving the indictment in place.

"Their position is our notice wasn't adequate however at the same time we notified them in open court," said Granison's attorney, John DeMarco. "It was on the record, they were aware of it, but felt like they needed to have it in writing."

Granison is facing gun and drug charges along with five other people who were arrested back in May as the culmination of a seven-month wiretap investigation.

Police say they found 31 grams of cocaine in Granison's car. Eight total locations were raided as part of the investigation, and law enforcement seized three firearms, one semi-automatic rifle, more than two kilos of powder and crack cocaine and more than $100,000 in cash. 

Granison is also charged with illegal possession of a handgun.
