ROCHESTER, N.Y. (WHEC) — One of the Rochester Police Officers involved in a police brutality case is suing the city and Police Chief La'Ron Singletary.

Spencer McAvoy is challenging the termination of his employment.

On May 5, 2018, Christopher Pate says he was forced to the ground, tased and punched in the face.

Pate matched the description of a suspect and McAvoy testified that Pate did not cooperate when asked for ID.

Former Officer Michael Sippel was convicted of a misdemeanor assault charge and fired from the RPD.

McAvoy, who was on the detail with Sippel, was never criminally charged but was terminated.
