Penfield man arrested in Webster fatal hit-and-run

WEBSTER, N.Y. (WHEC) —  Webster Police arrested the driver in the fatal hit-and-run crash on Empire Boulevard that left a woman dead and three others injured. 

Police arrested 27-year-old Maxwell M. Ward of Penfield Tuesday morning. He was arraigned in Webster Town Court on felony charges of criminally negligent homicide, leaving the scene of a fatal motor vehicle accident and leaving the scene without reporting a serious physical injury. He also faces two counts of leaving a personal injury accident, which are misdemeanors. Police also ticketed him for failing to use due care and moving from a lane unsafely.  


On June 20, officers said a Toyota RAV4 driving south on Empire Boulevard, near Ridge Road, hit four people. Ward did not stop after hitting the family, according to police.

Oksana Zakharchyshyn, 41, died at the scene. Police said she was walking with her family — Mariana Zakharchyshyn, 22, Oleksandra Zakharchyshyn, 15, and Maksym Tsybrii, 2 — to Abbot's Frozen Custard when they were struck. 

Mariana and Maksym were treated and released from the hospital. Oleksandra suffered serious injuries and is in guarded condition at Strong Memorial Hospital.

According to the criminal complaint, Ward admitted to a witness that he hit the family as he "bent to pick up his cell phone" with a cigar in his hand. 

Ward is being held in the Monroe County Jail with bail set at $25,000 cash or $100,000 insurance bond. A preliminary hearing is set for July 17 at noon.
