Police make 2nd arrest in murder of missing man whose SUV was found in Florida

ROCHESTER, N.Y. (WHEC) — Rochester Police announced a second arrest in the death of a man who went missing last July and whose car was found, set on fire, in Florida.

39-year-old Samuel Ortiz was reported missing on July 8, 2019. His SUV was found engulfed in flames in Florida on July 9, 2019.

Ortiz’s body was later found in an empty home on Lake View Park.

On July 13, 2020, police arrested parolee Kimberly Jones and charged her with murder, kidnapping, robbery and possession of stolen property in connection to the incident.

On Friday, Police say they arrested 42-year-old David Gardner of Rochester before he was released from Cape Vincent Correctional Facility and re-paroled to Rochester.

He was charged with second-degree murder, first-degree robbery, first-degree kidnapping and fourth-degree criminal possession of stolen property.

He is scheduled to be arraigned on Saturday in Rochester City Court.

Police say Gardner was convicted of manslaughter in the shooting death of a man in 1997. He was on parole in 2019. In August of 2019, he was taken into custody for parole absconding in Charlotte, North Carolina. He has been in custody since.
