Restaurant that sued over orange zone regulations get court order to get liquor license back

ROCHESTER, N.Y. (WHEC) — The owner of Veneto Wood Fired Pizza & Pasta got a court order to get his Buffalo Road location's liquor license back, at least temporarily. 

The Gates restaurant was flagged on New Year's Eve for operating in an Orange Zone, but the owner says his research indicated the restaurant was a Yellow Zone and he was hoping to straighten things out.

The liquor license was pulled even though the restaurant stopped serving immediately when management was told it was in an Orange Zone.

The owner told News10NBC he was afraid it was because he was part of an ultimately successful lawsuit by mostly Buffalo-area restaurants in Erie County's Orange Zone demanding the right to open under Yellow Zone regulations.

The restaurant's attorneys at HoganWillig, sent News10NBC a copy of the court order Wednesday night. 

It's a temporary restraining order while the owner appeals the State Liquor authority's decision.
