Three charged in connection to burglary spree

ROCHESTER, N.Y. (WHEC) — Multiple law enforcement agencies announced on Friday that three people have been charged in connection to thefts that took place across six counties. 

The three people arrested are 25-year-old Rochester resident Kristina Marble, 34-year-old Rochester resident Eric Smith, and 39-year-old Rochester resident Jose Cruz-Rosado. Together, law enforcement agencies believe they have been involved in over 30 "smash and grab" burglaries since mid-August. 


The initial arrests were made late on the night of Sept. 28 and early in the morning of Sept. 29 when a "multi-agency detail" discovered Marble's vehicle outside the Speedway gas station on W. Main Street in Victor, Ontario County. While observing, deputies heard glass break just before midnight and saw the vehicle leave. Deputies followed the vehicle while others confirmed that a burglary had taken place.

After that, Monroe County Sheriff's Deputies pulled the vehicle over for a traffic stop on Route 490-E just west of the Erie Canal. Upon pulling over, one man jumped out and ran towards the canal, while the other two- Marble and Smith- were taken into custody. The third person, Rosado-Cruz, tried to escape by jumping into the canal. However, he was unable to swim and so MCSO deputy Nicholas Mahoney had to jump into the canal to rescue him and bring him into custody. 

"In my head, I'm realizing that if nothing happens he's going to drown. so I make the choice at that point to jump in and swim out to him, was able to get him back to shore safely," said deputy Mahoney. 

Over the following days, other arrests and charges were put into place by other jurisdictions. The entire operation was the result of cooperation across several jurisdictions and agencies. 

It was cooperation that was hailed by Monroe County Sheriff Todd Baxter. 

"So the stories you're hearing about coordination, cooperation, communication, the heroics of the deputy jumping into the water, this is what law enforcement is all about," he said. "You know at this time in our community, at this time in our experience we hear a lot of negative about law enforcement. but what you [see] here is an example of what these guys and gals are doing on a nightly basis to protect our communities."

Overall, Kristina Marble is facing four felony charges, Eric Smith is facing four felony charges as well as misdemeanor and other charges, and Jose Cruz-Rosado is facing one charge of burglary in Ontario County as well as an extradition to Pennsylvania on a felony warrant.
