ALBANY, N.Y. (WHEC) — Legalizing online sports betting could face more opposition in New York, after a recent court ruling.
Last week, an appeals court ruled the State Legislature overstepped in its authority in 2016 when it declared daily fantasy sports is not a form of gambling banned by the State Constitution.
The court said the Legislature does not have the discretion to say what is and is not gambling, and that power is reserved to the constitutional amendment process, which involves voters of the state.
Gov. Andrew Cuomo has raised concerns before, that allowing online sports betting would require a constitutional amendment.
